Vendor Rules and Regulations
|
- Hours of Operation: Shopping hours for customers are from 9am through
6pm on Friday and 10am through 6pm on Saturday and Sunday. Vendors in the front row MUST open at the start and stay open until the close of every business day, vendors further in the market MUST open at the start of the weekend business day and stay open until the close of the market. Vendors will have access to booths on Thursday and Friday from 9am through 6pm and Saturday and Sunday 9am through 6pm. We do not take reservations over the phone. We do not take reservations without payment. Daily booth rentals cannot be reserved in advance, each daily space is on a first-come-first-serve business basis. Daily booth rentals must be paid in cash. Permanent dealers that are paying monthly rent may pay by check, with proper ID.
- Rent: Rent is due between the 25th of the previous month and the 1st of the month in question. Any vendors not fully paid by the first of the month may not be admitted to the market to service their booths during the week, and/or spaces may be over locked and will not be allowed to open on the weekend. Anyone selling, trading or otherwise conducting business on the premises must have a paid space receipt. No selling or trading or trading or otherwise conducting business in the parking lot without office permission. Monthly vendors must give a two week notice before leaving our market, if a vendor leaves without a two week notice a $250.00 fine per space will be added to his/her account. If your rent goes past due for more than two weeks, we retain the right to rent your space and auction off your merchandise.
- Fees: We require a $100 security deposit on our booths; the deposit is refunded by check by mail sent to the address on file when a written two week notice is given. There will be a $50 charge for any returned checks. We will not give refunds for payments made in advance. Monthly vendors who pay their rent after the due date will be charged 10% of the outstanding rent for $10 per day penalty. Monthly vendors that do not pay their rent in full by the 1st of the month could lose their spaces. Monthly vendors who are absent for more than one weekend a month will be charged a $50 fee per absent business day. Vendors must open their booths no later than 30 minutes after the start of the business day and must stay until the close of the business day!
- Licenses: All vendors must have a Lowndes County License. You can get your license application from the Lowndes County Board of Commissioners at 300 N Patterson Street in Valdosta GA 31601. Or call Deann Hayes at (229)-671-2534 for more information. County Licenses are required and enforced by Lowndes County Code enforcement. Your license will take 8 to 10 days to be available and must be presented to the office before you will be allowed to operate your booth. The county license is good from May 31 to May 31 of every year. By May 31st of each year monthly vendors must present a current license to continue to operate their booth.
- Vendor Dress and Behavior: Vendors and their employees are expected to dress and conduct themselves in a proper and professional manners at all times. All vendors must wear full clothing and shoes. Good personal hygiene, appearance, and courtesy to customers and all other vendors is expected. Profanity, loud boisterous action or physical violence will not be allowed. Radios, TV's and all other electrical devices must be kept to a minimum volume level so as not to disturb other vendors and customers. Music with vulgar lyrics is not allowed. Offending vendors will be asked to leave the market. Vendors caught stealing or destroying other vendors merchandise or displays will be barred from the market and subject to full penalties under the law. Children of the vendors and vendors employees must be kept in the vendor's space at all times and not be allowed to roam the market.
- Vendor Garbage and Cleanup: Vendors are required to clean up their rented
spaces at the close of business each day. All garbage shall be disposed of in the
appropriate dumpster. Smoking is allowed in the outside areas ONLY! Do not
throw butts on the floor and only dispose of in the appropriated receptacle. No
paper boxes or trash are allowed to accumulate under tables. Vendors not
adhering to the trash disposal procedures as stated above will be subject to severe
fines. Vendors are responsible for breaking down boxes and taking them to the
back of the market to the dumpsters.
- Banned Items: The following items are not allowed to be sold or brought to the
market:
- dangerous or poisonous chemicals, or other similar items considered hazardous to the public.
- animals such as dogs with vicious tendencies, poisonous snakes, large cats or other predatory animals (or any animals unless appropriate licensing and authorization from management is in place.)
- offensive books and/or other material (pornography, occult or witchcraft)
- no illegal, counterfeit or stolen items.
- no drugs related paraphernalia; liquor or decorative decanters filled with liquor.
- no guns or ammo of any kind.
- Merchandise: Vendors are required to limit their merchandise to the categories
they have specified in the original rental agreement/vendors application; if and when a vendor chooses to make changes of merchandise, any change or additions need to be verified and approved by the office.
- Refunds/Returns/Exchange Policy: All vendors selling new merchandise must
issue receipts. All vendors are required to post a refund/return/exchange policy at
their booths. The sign must be a minimum of 81/2” x 11” in size and be clearly
visible to all customers. Vendors are not required to make cash refunds, but must
clearly indicate what their particular refund/return/exchange policies are. All vendors must
clearly post their policy concerning breakage of items at their booth. If your policy is
“You Break You Buy”, then it must be clearly posted to be enforced.
- Additions to Booth:Any backboards, shelves, etc. or any type of construction
must be approved by the Market and built in accordance will all applicable building codes. The Market has no responsibility for any personal property. All materials must be new and must be painted in conformance with the market's approval.
- Subletting or Loaning Booths is Prohibited: Vendors are prohibited from subletting or loaning their assigned booths to any person(s) or entity. Any vendor caught subletting or loaning their assigned booth to anyone else, may be subject to being banned from the market.
- Dispute Resolution: Any and all disputes arising out of vendors' use of space in Grand Oaks Flea Market and/or arising out of these Rules and Regulations, whether grounded in tort, contract, or any other legal theory, shall be determined by binding arbitration held in accordance with American Arbitration Association Expedited Procedures of the Commercial Arbitration Rules. As a condition precedent to either party's right to demand arbitration, the parties shall share equally the fees and costs of mediation. Venue for any mediation, arbitration, and/or litigation between the parties shall be exclusively in Valdosta, Lowndes County, Georgia. The parties hereby waive their right to trial by jury.
- Attorney's fees and Costs: In the event Grand Oaks Flea Market is required to
take any action to correct any unpaid debt owed to it by the vendor, Grand Oaks Flea Market shall be entitled to recover from the vendor its reasonable attorney's fees and costs incurred in attempting to collect the debt, and/or incurred in any mediation,arbitration, litigation, or appeal. In the event of any arbitration or litigation between the parties, whether grounded in tort, contract, or any other legal theory, the prevailing party shall be entitled to recover its reasonable attorney's fees and costs incurred in any such proceeding, including appeals.
- Liabilities, Indemnification, and Hold Harmless Agreement: Grand Oaks
Flea Market is not responsible for any loss, causality, theft of, or damage to vendor's property at the market or otherwise, nor for any liabilities arising from vendor's negligence, gross negligence, and/or intentional acts. Vendor agrees to indemnify and hold harmless Grand Oaks Flea Market from and against any and all injury or damage to any person or property arising from or in connection with the presence and/or acts or omissions by the vendor or any of vendor's employees, agents, offices, customer, ar invitees.
- Liens for Unpaid Rent: Vendors hereby agree that Grand Oaks Flea Market shall have a lien on any of the vendor's merchandise left in the vendor's space for any unpaid rent or other obligation of the vendor to Grand Oaks Flea Market. In order to satisfy said lien, vendor hereby authorizes Grand Oaks Flea Market to sell vendor's merchandise left in the vendor's space at a public or private sale without any further notice to vendor and apply all proceeds from the sale of said merchandise to the expenses of sale, including attorney fees, then the vendor's obligation for rent, and then, the excess, if any will be paid to the vendor.
- No Partnership or Joint Venture: The parties specifically agree and understand that nothing in the Rules and Regulations and that nothing in the agreement between the parties shall in any way create a partnership or joint venture between the parties.
- Insurance: Grand Oaks Flea Market's insurance does not cover vendors or their property. At vendor's sole option, vendor may obtain adequate insurance to cover their property and liability.
- Licenses, Permits, Taxes, etc: All vendors are responsible for paying and obtaining any and all licenses, permits, taxes, etc., which may be required by Federal, State, and/or local governing bodies in connection with their operation.
- Entire Agreement: These Rules and Regulations constitute the entire agreement between parties and all prior representations, statements, and negotiations are hereby merged and integrated into these Rules and Regulations.
- Intrest on Unpaid Rent: All rent payments and other financial obligations of vendor pursuant to these Rules and Regulations shall bear interest at the rate of 1 ½% per month until paid.
- Modifications of the Rules: These are the rules of the market. Other rules and regulations deemed in the best interest of the market will be added, amended or changed and all vendors are required to adhere to these policies. No prior notice of such additions, amendments, modifications, and/or changes is required.
- Renting Constitutes Agreement to Adhere to Rules: By renting in this market, every vendor hereby agrees to adhere to these rules, including all additions, admentments, modifications, and/or changes to the rules.
- Right to Refuse Rent: The market reserves the right to refuse rent to any vendor for any reason not prohibited by law.
- No Assignment: Vendors are prohibited from assigning any of their rights, privileges, and/or obligations under this agreement without the prior written consent of Grand Oaks Flea Market.
- Agreement for Rental Space Only; No Bailment Created: This agreement is to provide space rental only. There is no agreement to create a bailment of vendor's goods and possessions. There is neither temporary, nor permanent, dominion or control exercised over vendor's goods and possessions and dominion and control over vendor's goods and possessions remain vendor's sole obligation. Grand Oaks Flea Market shall not be liable for the care and protection of vendor's goods and possessions.
